PART IV — ENFORCEMENT & GOVERNANCE

26.Monitoring & Enforcement

Benmort actively monitors activity within the ecosystem to protect users and maintain platform integrity. We use a combination of automated systems, manual review, user reporting, and compliance monitoring to detect potential violations.

Monitoring activities may include:

  • Content moderation and review
  • Security scanning and anomaly detection

  • Communications monitoring where lawfully permitted
  • Identity verification and document review
  • Compliance checks and periodic account reviews
  • Review and rating integrity monitoring
  • AI-assisted pattern recognition

Monitoring is conducted in accordance with applicable law and the Benmort Privacy Policy. The existence of monitoring does not mean that Benmort guarantees the detection of all violations.

27.Reporting Violations

Everyone in the Benmort ecosystem has a role in keeping it safe and honest. If you encounter conduct that may violate this Policy or applicable law, we encourage you to report it through our official channels.

Reports should include, where possible:

  • A description of the suspected violation.
  • The date, time, and location (URL or feature) where it occurred.
  • Details of the account or individual involved, if known.
  • Any supporting evidence, screenshots, or documentation.

28.Investigation Process

When a potential violation is reported or detected, Benmort will assess the seriousness and nature of the issue, take immediate protective measures where necessary such as temporary account restriction, conduct a fair and reasonable investigation, provide the affected user with an opportunity to respond where appropriate, and communicate the outcome of the investigation within a reasonable period.

During an investigation, we may request additional information, place restrictions on account activity, review communications and transaction records, and engage qualified third-party investigators or legal advisers where necessary.

The investigation process will be conducted with fairness, confidentiality, and proportionality. The complexity of a particular case may affect the time required to reach a conclusion.

29.Consequences of Violations

Consequences for violations are applied in proportion to the seriousness of the conduct. The table below provides a general guide to the consequences that may apply:

Your appeal should:

  • Clearly identify the account action you are appealing.

Appeals will be reviewed by a member of the Benmort team who did not participate in the original enforcement decision. We will acknowledge receipt of your appeal promptly and aim to communicate a decision within a reasonable period.

31.Cooperation with Authorities

Benmort cooperates with law enforcement and regulatory authorities in accordance with applicable law. Where required or lawfully permitted to do so, Benmort may disclose user information to relevant authorities where there is a reasonable basis to believe that unlawful activity has occurred or is occurring.

Users must not use Benmort services to obstruct, impede, or interfere with any lawful law enforcement or regulatory investigation. Attempts to use Benmort services to destroy evidence, conceal unlawful activity, or flee legal accountability may themselves constitute violations of this Policy and applicable law.

32.Amendments

Benmort may update this AUP from time to time to respond to new threats, legal changes, platform developments, or evolving best practices. We will communicate material changes through our official channels before they take effect.

Continued use of Benmort Connect services after the effective date of any revision constitutes acceptance of the updated Policy. We encourage you to review this AUP periodically.

This AUP supplements and forms part of the Benmort Connect policy framework. It should be read alongside:

  • Privacy Policy
  • Service-specific Terms and Conditions (Marketplace, BBS, BCH, BGS, Benmort Pay)
  • Referral Programme Terms
  • Ambassador Agreement
  • Partner Agreement
  • Cookie Policy

In the event of any conflict between this AUP and another Benmort policy on an acceptable use matter, this AUP prevails to the extent of the inconsistency.

34.Governing Law

This Policy is governed by the laws of the jurisdiction in which the relevant Benmort contracting entity operates, unless otherwise required by applicable mandatory law. Nothing in this Policy limits any rights granted to individuals under applicable consumer protection or regulatory laws.

35.Severability

If any provision of this Policy is found to be invalid, unlawful, or unenforceable, that provision will be read down or severed to the minimum extent necessary. The remaining provisions shall continue in full force and effect.
