PART I — GENERAL PROVISIONS

1.Introduction

Welcome to Benmort Global Services (“BGS”).

These Terms & Conditions (“BGS Terms”) govern your access to and use of all international education, workforce mobility, career development, travel support, immigration support coordination, professional training, and related services provided under Benmort Global Services.

These BGS Terms form part of the Benmort Connect legal framework and supplement the Benmort Connect General Terms of Use. Where there is a conflict between these BGS Terms and the General Terms of Use on a BGS-specific matter, these BGS Terms shall take precedence on that point only.

By registering for, purchasing, applying for, participating in, or using any Benmort Global Services, you confirm that you have read, understood, and agree to be legally bound by these Terms.

2.What BGS Is Here to Do

Benmort Global Services exists to help individuals and organisations prepare for international opportunities — whether that means studying abroad, pursuing a career in another country, obtaining professional licensing in a new jurisdiction, or navigating the complex process of international mobility.

We provide professional guidance, coordination, training, and administrative support. We are genuinely invested in your success, and we work hard to give you the best possible preparation and the strongest application we can help you build.

What we cannot do is make the decisions that belong to universities, employers, licensing bodies, embassies, immigration authorities, and other independent institutions. Those decisions are made by those organisations alone, and they are influenced by many factors that lie entirely outside our control.

What we can promise is our best professional effort at every stage of the process.

3.Scope of Services

Benmort may introduce additional international mobility, education, recruitment, consulting, or support services from time to time. We will communicate new services through our official channels.

4.Eligibility

To use Benmort Global Services, you must:

  • Be at least eighteen (18) years of age, or otherwise possess the legal capacity to enter into binding agreements under the laws applicable to you.
  • Provide information that is complete, accurate, and truthful at all times.
  • Comply with all applicable laws and regulations in your home country and any destination country relevant to your application.
  • Submit only authentic, unaltered, and lawfully obtained supporting documents where requested.
  • Accept these Terms and any service-specific requirements that apply to the services you are using.

Parents, guardians, or legally authorised representatives may act on behalf of minors or individuals who lack legal capacity, where permitted by law. In such cases, the representative accepts these Terms on behalf of the individual.

5.User Registration

You may be required to create a Benmort Connect account and complete a registration process before accessing certain BGS services. Your account is your personal record with us — please take good care of it.

You agree to:

  • Keep your personal information accurate, current, and complete throughout your engagement with us.
  • Promptly update any changes to your contact details, qualifications, or circumstances that may affect your application.
  • Safeguard your account credentials and not share them with others.
  • Notify Benmort immediately if you become aware of any unauthorised use of your account.

We may request additional documentation to verify your identity or eligibility before providing services. We will handle all information you share with us in accordance with our Privacy Policy.

6.Document Verification

The integrity of your application depends entirely on the authenticity of the information and documents you submit. Applicants are solely responsible for ensuring that all documents provided to Benmort are accurate, complete, authentic, and lawfully obtained.

Depending on the service, we may request documents including:

  • Passport or national identity card
  • Language test results
  • Birth certificate
  • Police clearance certificates
  • Educational certificates and transcripts
  • Medical reports (where required)
  • Professional licences
  • Financial documents
  • Curriculum vitae (CV)
  • Any other relevant documentation
  • Employment references

7.Your Responsibilities

As an applicant or client, your active participation and cooperation are essential to the success of your application. You agree to:

  • Provide truthful, accurate, and complete information at every stage of the process.
  • Submit all required documents by any deadlines communicated to you.
  • Respond promptly to our requests for additional information or clarification.
  • Attend all scheduled interviews, appointments, and training sessions where required.
  • Follow the instructions and requirements of universities, employers, licensing bodies, embassies, immigration authorities, and other relevant institutions.
  • Maintain professional conduct throughout the entire service engagement.

Please understand that Benmort can only work with what you give us. Delays or adverse outcomes arising from your failure to meet these responsibilities are outside our control, and we will not be responsible for them.

8.Our Responsibilities

Benmort is committed to providing its services with reasonable skill, care, and diligence. Where applicable and included in your service package, we may:

  • Assess your eligibility for available pathways and provide honest, informed guidance.
  • Advise on application requirements and help you understand what institutions expect.
  • Assist with document preparation and review to improve the quality of your submission.
  • Coordinate with approved third-party partners on your behalf.
  • Provide training, orientation, and preparation programmes.
  • Facilitate communication with third-party institutions where you have authorised us to do so.
  • Monitor application progress where practicable and keep you reasonably informed.

Benmort is not responsible for the independent decisions of universities, employers, governments, immigration authorities, licensing bodies, or any other third party. Our responsibility is to prepare and support you to the best of our ability — the decisions belong to others.

9.Third-Party Organisations

Many BGS services involve working with independent third parties that make their own decisions and operate under their own policies. These include:

  • Universities and colleges
  • Embassies and consulates
  • Employers
  • Airlines
  • Recruitment agencies
  • Insurance providers
  • Examination bodies
  • Accommodation providers
  • Professional licensing authorities
  • Government agencies
  • Immigration authorities
  • Credential evaluation bodies

These organisations operate entirely independently of Benmort. We cannot control their eligibility requirements, policies, processing times, fees, decisions, or procedures. Where we have established relationships with trusted partners, we will always aim to work with organisations that share our commitment to quality and professional standards.

10.Service Packages

Benmort may offer its services through different packages, tiers, subscriptions, or customised engagements designed to meet different needs and budgets. Before you purchase, we will clearly communicate the package description, pricing, inclusions, exclusions, timelines, and eligibility requirements.

If you request services that fall outside your selected package, these may be subject to additional fees. We will always advise you of any such costs before they are incurred.

11.Appointments & Consultations

We offer consultations in the format that works best for you. Appointments may be conducted:

  • In person at an approved Benmort location.
  • Virtually through video conferencing.
  • By telephone.
  • Through other approved communication methods.

Please attend your appointments on time. Rescheduling fees may apply where notice is not given within the timeframe communicated at booking. If life happens and you need to reschedule, please let us know as early as possible.

12.Communication

We want to keep you informed and supported throughout your journey with us. Benmort may communicate with you through email, telephone, SMS, WhatsApp, the Benmort platform, or other approved channels.

Please ensure your contact details are always current and that you check your messages regularly. We will not be responsible for delays or missed communications arising from inaccurate contact information or your failure to respond to our outreach.

13.Professional Conduct

We ask everyone who engages with Benmort Global Services to conduct themselves with honesty and respect. All clients, applicants, partners, and representatives agree to:

  • Treat Benmort personnel, partners, and third-party contacts with courtesy and professionalism.
  • Refrain from abusive, threatening, discriminatory, or unlawful behaviour of any kind.
  • Comply with all applicable laws and institutional rules relevant to their engagement.
  • Avoid providing false, misleading, or exaggerated information at any point in the process.

Benmort reserves the right to suspend or terminate services where professional standards are not upheld.

PART II — STUDY ABROAD SERVICES

14.Study Abroad Services

Our study abroad services are designed to help you navigate the complex process of applying to educational institutions internationally. We act as your advisor and coordinator — we are not an educational institution ourselves.

Services in this stream may include education counselling, course selection guidance, institution matching, application preparation and submission support, document review, scholarship guidance, visa documentation guidance, pre-departure orientation, student travel support, and accommodation guidance.

15.Education Counselling

Our education counsellors will work with you to identify programmes and institutions that genuinely match your profile, goals, and circumstances. In providing guidance, we will consider:

  • Your academic qualifications and academic history.
  • Your career aspirations and long-term goals.
  • Your financial capacity and scholarship eligibility.
  • Any immigration objectives relevant to your destination choice.
  • Eligibility requirements of institutions you are considering.

Guidance is designed to inform and improve your decisions — but the final choice of programme and institution always remains yours.

16.Institution Matching

Our institution recommendations are based on the best available information at the time of your assessment. When matching you to institutions, we may consider factors such as:

  • Academic qualifications
  • Budget and financial capacity
  • English language proficiency
  • Country and region preference
  • Professional background
  • Institution entry requirements
  • Work experience
  • Immigration eligibility

Recommendations reflect our professional assessment of where you have a good chance of success. They are not a guarantee of admission.

17.Application Preparation

We can help you put together a strong application. Our support may include:

  • Application form completion
  • Motivation letters
  • Curriculum vitae (CV)
  • Recommendation letter guidance
  • Personal statement
  • Document organisation
  • Statement of purpose (SOP)
  • Application checklists

Before anything is submitted, you must review and approve all application materials. You remain responsible for the accuracy and truthfulness of everything submitted in your name.

18.Application Submission

Where you authorise us to do so, Benmort may submit applications to educational institutions and approved partners on your behalf. By authorising submission, you confirm that all information included is accurate and that you consent to Benmort transmitting your documentation as required.

19.Supporting Documents

You are responsible for providing authentic and complete supporting documents. Depending on your application, these may include academic transcripts, certificates, passports, identity documents, language test results, financial documents, employment records, recommendation letters, and any other materials required by the institution.

Benmort reserves the right to decline applications where submitted documentation is incomplete, inconsistent, or raises authenticity concerns.

20.Scholarship Guidance

Benmort may help you identify scholarship opportunities that match your profile and assist you with the search, eligibility review, application guidance, documentation, and interview preparation. We genuinely want to help you access every financial opportunity available to you.

Scholarship awards are made entirely at the discretion of scholarship providers. We cannot influence or guarantee the outcome of any scholarship application.

21.English Language Proficiency

Many institutions and immigration programmes require recognised English language test results. Benmort may provide guidance relating to IELTS, OET, PTE Academic, TOEFL, Duolingo English Test, and other recognised assessments. We may also provide or coordinate preparation programmes through approved instructors or partner organisations.

Examination registration, scoring, and certification are managed entirely by the relevant examination bodies. Benmort does not administer language examinations and cannot influence test results.

22.Admission Decisions

Admission decisions are made solely and exclusively by educational institutions. Benmort has no authority to approve applications, influence decisions, alter admission criteria, or modify institutional policies.

You acknowledge that meeting the minimum published entry requirements does not guarantee an offer of admission. Institutions may request further documentation, may apply additional selection criteria, and may withdraw offers in accordance with their own policies and procedures.

23.Visa Documentation Guidance

Where visa documentation is required for your destination country, Benmort may assist you by providing document checklists, document organisation support, application preparation guidance, interview preparation, pre-submission review, and general procedural information.

Benmort does not issue visas. We do not represent any embassy, consulate, immigration authority, or government agency. Our role is to help you prepare the strongest possible documentation for submission.

24.Visa Decisions

Visa decisions are made exclusively by the relevant embassy, consulate, or immigration authority. Benmort has no ability to approve visas, expedite government processing times, or influence the decisions of immigration officers.

25.Accommodation Guidance

Where you request it, Benmort may provide information or referrals regarding accommodation options including university residences, private accommodation, host families, temporary housing, or partner accommodation providers.

All accommodation agreements are entered into directly between you and the accommodation provider. Benmort is not a party to those agreements and is not responsible for accommodation quality, availability, pricing, or any disputes that arise.

26.Travel Support

Our travel support services are designed to help you prepare for the practical realities of international travel. Support may include travel readiness guidance, travel documentation advice, baggage guidance, airport procedures, arrival information, travel checklists, and destination orientation.

Travel arrangements remain subject to airline policies, immigration requirements, and applicable government regulations. Benmort supports your planning — the operational decisions lie with airlines, airports, and authorities.

27.Flight Reservation Assistance

Where requested, Benmort may facilitate flight reservations through approved travel partners. You acknowledge that airline schedules may change, fares are subject to availability and change, airline terms and conditions govern the booking, and cancellations and refunds are handled according to airline policies.

Benmort is not liable for operational decisions made by airlines, including delays, cancellations, schedule changes, or seating arrangements.

28.Travel Insurance

We may recommend or facilitate access to travel insurance products offered by licensed insurance providers. Insurance contracts are entered into directly between you and the insurance provider. Please take the time to review policy terms, coverage, exclusions, and claim procedures carefully before purchasing any insurance product.

29.Pre-Departure Orientation

Where available, Benmort organises pre-departure orientation to help you arrive in your destination country feeling prepared and confident. Orientation sessions may cover:

  • Travel preparation
  • Healthcare systems
  • Immigration arrival procedures
  • Employment restrictions for students
  • Cultural awareness
  • Emergency contacts
  • Accommodation expectations
  • Local laws and safety
  • Budgeting
  • Cultural adjustment guidance

Orientation is designed to inform and prepare you — it is not a substitute for your own research or the guidance of official government sources.

30.Student Responsibilities

Once enrolled, students take on their own set of responsibilities that are critical to maintaining their status abroad. You agree to:

  • Comply with all institutional rules, regulations, and codes of conduct.
  • Maintain lawful immigration status and comply with all visa conditions at all times.
  • Attend classes and meet the academic requirements of your programme.
  • Maintain valid passports and travel documents throughout your studies.
  • Comply with all applicable local laws in your destination country.
  • Notify Benmort of any significant changes that affect your application where we are still providing active support.

Benmort will not be responsible for consequences arising from a failure to comply with institutional or immigration requirements. Immigration status and continued enrolment are your responsibility to maintain.

PART III — WORK ABROAD & HEALTHCARE PATHWAYS

31.Work Abroad Services

Benmort Global Services provides workforce mobility advisory, career readiness, and international employment support for skilled, semi-skilled, and unskilled workers. We help candidates build the strongest possible profile and access international employment opportunities through trusted channels.

Services in this stream may include career pathway assessment, employment readiness programmes, international recruitment support, employer matching, documentation guidance, skills assessment guidance, professional profile development, interview preparation, pre-departure orientation, settlement readiness, and employer onboarding coordination.

Benmort facilitates access to employment opportunities but is not the employer unless this is expressly stated in writing in a separate agreement.

32.Candidate Registration

To access work abroad services, candidates must complete Benmort’s registration process and provide accurate and complete information regarding their identity, educational qualifications, professional certifications, employment history, skills and competencies, criminal record declarations where applicable, medical fitness where required, and immigration history where relevant.

Benmort reserves the right to decline registration where information is incomplete, misleading, inconsistent with supporting documentation, or raises concern.

33.Employment Readiness Programmes

We offer structured programmes designed to improve your readiness and competitiveness in international job markets. These may include CV and résumé enhancement, cover letter preparation, professional branding, interview coaching, workplace communication skills, digital literacy, cultural orientation, employer expectation training, workplace ethics, and country-specific employment preparation.

Participation in these programmes improves your preparation — but it does not guarantee employment. The final hiring decision rests with employers.

34.Employer Matching

Benmort may introduce qualified candidates to prospective employers or licensed recruitment partners based on factors including qualifications, professional experience, skills, language proficiency, licensing status, employer requirements, immigration eligibility, and availability.

We work hard to find the best possible match for each candidate, but we cannot guarantee that any candidate will be matched with an employer or that a match will result in a job offer.

35.Recruitment Support

Where applicable, Benmort may coordinate recruitment activities including candidate shortlisting, profile submission, employer introductions, interview scheduling, candidate follow-up, documentation coordination, offer communication, and pre-employment preparation.

Employment contracts are entered into directly between candidates and employers. Benmort is not a party to employment contracts unless expressly identified as the employing entity in a separate written agreement.

36.Healthcare & Nursing Pathways

Benmort provides specialist advisory and support services for healthcare professionals seeking international career opportunities. We work with a range of healthcare professionals including:

  • Registered Nurses
  • Radiographers
  • Midwives
  • Occupational Therapists
  • Physicians
  • Healthcare Assistants
  • Pharmacists
  • Caregivers
  • Physiotherapists
  • Other regulated healthcare professionals
  • Medical Laboratory Professionals

Professional licensing, registration, and credentialing decisions are made by the relevant licensing and regulatory authorities in each destination country. Benmort’s role is to guide and prepare you for that process — not to make decisions on behalf of those bodies.

37.Professional Licensing Guidance

Depending on your destination country and profession, professional licensing requirements will vary. Benmort may provide information and administrative guidance relating to licensing processes including, where applicable:

  • NCLEX-RN and NCLEX-PN
  • IELTS Academic and OET
  • CBT (Computer-Based Testing)
  • PTE Academic
  • NMC Registration (UK)
  • Credential evaluations
  • AHPRA Registration (Australia)
  • Police clearances
  • CGFNS Certification
  • Medical examinations

Benmort does not administer examinations or issue professional licences. All examination and licensing decisions rest with the relevant bodies.

38.Examination Preparation

Benmort may provide or coordinate examination preparation programmes through qualified trainers or approved education partners. Preparation support may include classroom instruction, online learning, practice examinations, coaching sessions, learning materials, study plans, and mentorship.

Preparation programmes improve your readiness and your chances of success. However, examination outcomes are determined by the relevant examination bodies and cannot be guaranteed.

39.Skills Assessment

Certain occupations in specific destination countries require formal skills assessments conducted by designated authorities. Benmort may provide guidance on assessment requirements, documentation, evidence preparation, and application procedures.

All final assessment decisions are made solely by the designated assessment authorities. Benmort does not conduct official skills assessments.

40.Documentation Support

Benmort may assist you with preparing employment-related documentation including your CV or résumé, cover letters, employment verification letters, professional references, licensing documentation, credential evaluation applications, and identity documentation checklists.

You remain responsible for the authenticity and accuracy of all information included in documents submitted in your name.

41.Interview Preparation

Our interview preparation services are designed to help you perform at your best. Services may include mock interviews, competency-based interview coaching, behavioural interview preparation, technical interview preparation, employer briefing sessions, and communication coaching.

Interview performance and employment decisions remain the responsibility of you and the prospective employer. We can prepare you thoroughly, but we cannot sit in the interview chair for you.

42.Employment Offers

Employment offers are issued solely by employers or their authorised recruitment partners. You are responsible for reviewing any employment contract you receive, understanding your salary, benefits, and conditions, and obtaining independent legal or financial advice where appropriate.

Benmort is not a party to employment contracts unless expressly stated in writing.

43.Employer Responsibilities

Employers participating in Benmort programmes are expected to meet high standards of ethical and lawful recruitment. Participating employers agree to:

  • Comply with all applicable labour, employment, and immigration laws.
  • Provide accurate and honest job descriptions to candidates.
  • Honour employment agreements once signed.
  • Maintain lawful, transparent, and non-discriminatory recruitment practices.
  • Respect internationally recognised ethical recruitment standards.
  • Provide safe working conditions where required by applicable law.

Benmort may suspend or end its collaboration with any employer that fails to meet these expectations.

44.Candidate Responsibilities

Candidates working with BGS’s work abroad services agree to:

  • Provide truthful, accurate, and current information throughout the process.
  • Maintain professional conduct in all interactions with Benmort, employers, and partners.
  • Respond promptly to employer communications and attend scheduled interviews.
  • Complete required documentation on time.
  • Comply with employer policies, instructions, and workplace standards.
  • Observe all applicable immigration and employment laws in the destination country.
  • Maintain valid travel and identification documents.

45.International Recruitment Partners

Benmort may collaborate with licensed recruitment agencies, healthcare institutions, employers, educational institutions, and workforce partners globally. Partner organisations are independent entities that make their own decisions regarding recruitment, employment contracts, compensation packages, workplace policies, and operational procedures.

Benmort is not responsible for decisions independently made by partner organisations. Where we believe a partner is not meeting expected standards, we will review our relationship with them.

46.Ethical Recruitment

Benmort is committed to ethical recruitment principles and operates in alignment with applicable national laws and internationally recognised good practice frameworks. We encourage all partners to promote fair recruitment, avoid discrimination, provide transparent and honest recruitment information, respect worker rights, and comply with applicable labour standards.

If you ever suspect that recruitment practices you are experiencing through a Benmort-connected partner are unethical or unlawful, please report this to us immediately. We take such reports seriously.

PART IV — COMMERCIAL TERMS

50.Service Fees

The fees charged by Benmort are service fees for the professional advisory, administrative, coordination, training, documentation support, and other services we provide. Unless expressly stated otherwise in writing, Benmort’s fees do not include payments to universities, employers, embassies, immigration authorities, examination bodies, licensing authorities, airlines, insurance companies, accommodation providers, or other third parties.

Third-party fees are the responsibility of the client unless they are expressly included in a purchased service package. We will always be transparent about what is and is not included before you commit to a package.

51.Payment Terms

You agree to pay all applicable fees in accordance with your selected service package or written quotation. Payments may be made through Benmort Pay, approved banking channels, mobile money, approved payment gateways, or other payment methods approved by Benmort.

Where instalment plans are offered and you have agreed to one, please comply with the agreed payment schedule. Failure to make payments when due may result in the suspension or cancellation of services without further notice.

52.Third-Party Fees

Your pathway may involve fees payable directly to independent third parties. These may include:

  • Universities and colleges
  • Airlines
  • Examination bodies
  • Accommodation providers

Benmort is not responsible for changes to third-party pricing, exchange rate fluctuations, additional taxes, or surcharges imposed by these organisations. We will advise you of known third-party costs where we are aware of them, but always check directly with the relevant body for the most up-to-date information.

53.Refund Policy

Refund requests are considered in accordance with the Benmort Refund Policy and the specific terms of your service agreement. We handle each request individually and fairly.

Unless otherwise required by law or expressly agreed in writing, service fees are generally non-refundable once advisory, consultation, administrative, documentation, coordination, or training services have commenced.

Refunds will not ordinarily be granted in the following circumstances:

  • An educational institution declines your application for admission.
  • A scholarship application is unsuccessful.
  • A visa or permit application is refused.
  • An employer declines to hire you.
  • A licensing authority refuses registration.
  • An examination is failed.
  • You withdraw voluntarily after services have already commenced.
  • Delays arise due to your failure to provide required information or documentation on time.

Where a refund is approved, any non-recoverable third-party costs and applicable administrative charges may be deducted from the refund amount.

54.Cancellations

You may request cancellation of services at any time by providing written notice to Benmort. However, cancellation does not automatically entitle you to a refund. Please refer to Section 53 and our Refund Policy for details.

Benmort may cancel or suspend services in the following circumstances:

  • False or misleading information has been provided.
  • Fraudulent or altered documents have been submitted.
  • Payment obligations have not been met.
  • Abusive, threatening, or unlawful conduct has occurred.
  • Continued engagement would breach applicable law.
  • Continued engagement presents a material operational, legal, or reputational risk to Benmort.

PART V — LEGAL PROVISIONS

55.Third-Party Decisions

Benmort has no authority to approve, reject, influence, or guarantee decisions made by independent third parties. This applies to all decisions relating to university admissions, scholarships, visas, work permits, immigration applications, employment offers, professional licensing, examination results, credential evaluations, border entry, residency, and citizenship.

Such decisions are made solely by the relevant institutions and authorities according to their own criteria, policies, and procedures. We will prepare and support you as thoroughly as we can — but we cannot make those decisions on your behalf or on your behalf influence those who do.

56.No Guarantee of Outcomes

Benmort provides professional guidance and support, not guaranteed results. The nature of international education, employment, immigration, and licensing is such that many factors influencing outcomes are entirely outside our control.

Without limitation, Benmort does not guarantee:

  • Admission to any educational institution
  • Employment offers
  • Scholarship awards
  • Employer sponsorship
  • Examination success
  • Specific salary levels
  • Visa approval
  • Permanent residence
  • Immigration approval
  • Citizenship
  • Professional licensing

Any timelines communicated by Benmort are estimates based on known information at the time. They may be affected by third-party processing times, policy changes, or circumstances entirely beyond our control.

57.Client Acknowledgements

By using Benmort Global Services, you acknowledge and accept the following:

  • The success of your application depends on multiple factors that are outside Benmort’s control, including the policies and discretion of institutions and authorities.
  • You are responsible for the accuracy, completeness, and authenticity of all information and documents you provide to Benmort.
  • You remain responsible for complying with the requirements of educational institutions, employers, licensing bodies, immigration authorities, and other relevant third parties.
  • Benmort’s role is limited to the professional services described in your selected package or written agreement.

58.Intellectual Property

All intellectual property created by Benmort — including training materials, templates, guides, manuals, checklists, digital content, branding, methodologies, software, and documentation — remains the exclusive property of Benmort or its licensors, unless otherwise agreed in writing.

You receive a limited, non-exclusive, non-transferable licence to use materials supplied to you solely for your personal or internal business purposes in connection with the service you have purchased. You may not reproduce, distribute, modify, publish, sell, or commercially exploit Benmort materials without our prior written consent.

59.Confidentiality

Both Benmort and our clients agree to protect confidential information shared during the course of our engagement. Confidential information includes personal and financial information, proprietary methodologies, application documentation, commercial information, and partner information.

Confidential information may only be disclosed with the consent of the owner, where required by law, or where reasonably necessary to provide the contracted services. These obligations survive the completion or termination of our engagement.

60.Data Protection

Benmort processes your personal information in accordance with the Benmort Privacy Policy, applicable data protection legislation, and regulatory obligations. Information may be processed for identity verification, application management, communication, payment processing, compliance, service delivery, reporting, and customer support.

Where necessary for the delivery of the services you have requested, you authorise Benmort to share relevant information with approved third-party institutions involved in your pathway. We will always aim to share only what is necessary.

61.Limitation of Liability

To the fullest extent permitted by applicable law, Benmort shall not be liable for:

  • Decisions made independently by third parties, including admission refusals, visa refusals, employment decisions, and licensing decisions.
  • Changes in immigration laws, policies, or processing procedures.
  • Examination failures.
  • Airline disruptions, accommodation disputes, or government actions.
  • Delays caused by third parties or events outside Benmort’s reasonable control.
  • Indirect, incidental, special, consequential, or punitive damages of any kind.
  • Loss of income, employment opportunities, profits, goodwill, or data.

Where our liability cannot lawfully be excluded, Benmort’s aggregate liability to you shall not exceed the total service fees paid by you to Benmort for the specific service giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

62.Indemnification

You agree to indemnify and hold harmless Benmort, its directors, officers, employees, affiliates, contractors, agents, and approved partners from any claims, liabilities, losses, damages, costs, or expenses arising from:

  • Inaccurate, misleading, or false information provided by you.
  • Submission of fraudulent or altered documents.
  • Your breach of these Terms.
  • Unlawful conduct in connection with your use of BGS services.
  • Violation of third-party rights.

63.Suspension and Termination

Benmort may suspend or terminate your services where these Terms are materially breached, fraudulent conduct is identified, required payments remain outstanding, legal or regulatory obligations require action, or where you present an unacceptable operational, legal, financial, or reputational risk.

Termination does not affect any rights or obligations that accrued before termination or that are intended to survive it.

64.Force Majeure

Benmort shall not be liable for delays or failures resulting from events beyond its reasonable control, including natural disasters, pandemics, war, civil unrest, terrorism, labour disputes, government actions, changes in law, telecommunications or internet failures, cyber incidents, airline disruptions, or failures by third-party service providers.

Where a force majeure event affects your service, we will notify you as soon as practicable and work with you to find the best way forward.

65.Dispute Resolution

We hope that any concerns can be resolved through open and honest conversation. If you have an issue, please come to us first. Where a dispute cannot be resolved through good-faith discussions, the parties may pursue mediation, arbitration, or court proceedings in accordance with the applicable agreement and governing law.

Nothing in this section prevents either party from seeking urgent interim relief from a court of competent jurisdiction where necessary to prevent immediate harm.

66.Governing Law

These Terms shall be governed by the laws of the jurisdiction in which the relevant Benmort contracting entity operates, unless a written agreement between the parties specifies otherwise or applicable law requires a different framework.

67.Amendments

Benmort may amend these Terms from time to time to reflect changes in law, business operations, partner requirements, or service offerings. We will notify you of material changes through our official channels before they take effect. Continued use of Benmort Global Services after the effective date of any revision constitutes acceptance of the updated Terms.

68.Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be read down or severed to the minimum extent necessary. The remaining provisions shall continue in full force and effect.

69.Entire Agreement

These Terms, together with the Benmort Connect General Terms of Use, the Benmort Privacy Policy, the Refund Policy, and any applicable service-specific agreements, constitute the complete agreement between you and Benmort Connect governing your use of Benmort Global Services.

71.Your Acceptance

By registering for, purchasing, applying for, or otherwise using Benmort Global Services, you confirm that you have read and understood these Terms & Conditions in their entirety and agree to be legally bound by them.

You further confirm that you understand the advisory and coordination nature of Benmort’s services and accept that admissions, employment, licensing, immigration, examination, and all other third-party decisions are made by those independent organisations alone and remain entirely outside Benmort’s control.
